BACKGROUND:
These Terms and Conditions shall apply to the use of the facilities and services provided by RAW Performance Gym.

Please read these Terms and Conditions ("Terms") carefully. By signing your membership agreement, enrolling in a programme, purchasing a pass, or using the facilities, you confirm that you have read, understood, and agreed to be legally bound by these Terms.

1. Definitions and Interpretation

  • “Gym”, “we”, “us”, “our”: Refers to RAW PERFORMANCE HITCHIN LTD (trading as RAW Performance Gym Hitchin), registered in England and Wales, with its registered office at [Insert Address], Company Number [Insert Number].

  • “Member”, “Participant”, “you”, “your”: Refers to the individual named on the membership account or programme enrolment form.

  • “PT”: Personal Training.

  • “Membership” / “Membership Plan”: A grade of gym, PT, or group training access as determined by the Gym.

  • “Membership Fees”: The recurring or upfront fees due for your chosen Membership or Programme.

  • "DFC": Debit Finance Collections Plc (or our designated third-party direct debit billing provider).

2. Gym Access and Membership Plans

  • Active Membership Required: In order to use the Gym facilities, attend fitness classes, or receive PT, you must hold an active Membership or be enrolled in a live fixed-term Programme.

  • Plan Tiers: Use of the Gym must align strictly with your chosen Membership Plan:

    • 24/7 Gym Access Membership (£44.99/mo): Allows full 24/7 access to the facilities.

    • PT & Transformation Plans: Subject to the specific terms set out in Schedule 1 and Schedule 2 below.

  • Access Rules: Entry is strictly personal. You must use your assigned access method (app QR code, card, or biometric entry). Lending your access method to anyone else will result in immediate termination of your membership without refund.

3. Health, Safety, and Physical Readiness

  • PAR-Q & Health Questionnaire: Before your first workout, fitness class, or PT session, you must complete an online consultation and Physical Activity Readiness Questionnaire (PAR-Q).

  • Medical Fitness: You confirm that you are medically fit to participate in physical exercise or have obtained explicit written medical clearance from a qualified healthcare professional.

  • Ongoing Duty to Inform: You must inform a member of gym staff immediately of any changes to your health, medical conditions, or injuries at any point during your time with us.

  • Conduct and Behaviour: You agree to follow all safety signs, gym rules, and verbal instructions given by staff. The Gym reserves the right to remove any member from the premises or terminate their contract permanently for abusive behaviour, vandalism, theft, or inappropriate conduct, with no refund.

4. Fees, Direct Debit, and Late Payments

  • Payment Method: All recurring monthly Membership Fees (Gym and PT) must be paid via Direct Debit through our billing provider, DFC.

  • Late Payment Fees: Failure to make timely payments will result in an automatic late payment fine issued directly by DFC. The Gym cannot overturn or waive this late fee.

  • Suspension of Access: Members will be automatically denied entry to the Gym and blocked from booking sessions or classes while any fees or sums remain outstanding.

  • Debt Collection: If Membership Fees remain unpaid for more than a 30-day period, the Gym will automatically refer the matter to a third-party debt collection agency.

5. Statutory Consumer Cancellation Rights (Cooling-Off Period)

  • 14-Day Window: If you purchased your membership or programme online or away from the gym premises, you are entitled to a statutory 14-day cooling-off period under UK consumer law.

  • Pro-Rata Charges & Waivers: If you request to start your membership, attend a class, or log into digital services within this 14-day window, you acknowledge that you are requesting services to begin immediately. Any refund will be reduced pro-rata to reflect the days used or services already delivered. If a specialized fixed-term programme has already fully commenced, you may lose the right to cancel.

6. Liability and Personal Belongings

  • Personal Injury: Nothing in these Terms limits or excludes our liability for death or personal injury caused directly by our negligence or that of our staff.

  • Inherent Risks: You acknowledge that physical training carries inherent risks of injury or illness. To the fullest extent permitted by law, the Gym is not liable for injuries sustained during voluntary participation, except where caused by our breach of duty.

  • Personal Property: Lockers are provided for your convenience. The Gym accepts no liability for lost, stolen, or damaged personal property brought onto the premises, unless the loss is a direct result of our negligence.

7. Data Protection and GDPR

  • Data Processing: We process your personal information and sensitive health data in strict compliance with the UK GDPR and the Data Protection Act 2018. Your data is used solely to manage your membership, safety, and training tracking.

8. Governing Law

  • These Terms are governed by and interpreted in accordance with English law, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

SCHEDULE 1: STANDARD ROLLING & PT MEMBERSHIPS

(Applies to monthly Gym and Personal Training Plans)

S1.1 Contract Lengths and Rolling Terms

  • Standard Gym Memberships: Subject to a mandatory 6-Month Minimum Contract.

  • Personal Training (PT) Memberships: Subject to a mandatory 3-Month Minimum Contract.

  • Rolling Status: Once the initial 3 or 6-month commitment is complete, the contract automatically becomes a rolling monthly contract. Fees will continue to be collected until formal cancellation is processed. This must be done via email to info@rawperformance-gym.co.uk no less than 30 days before the next fee is due to be taken.

  • PT Membership Tariffs: Pricing starts from the following baseline scales:

    • From £135.00/mo: 3-month contract, providing 12 PT sessions total (broken down to 4 sessions per month).

    • From £270.00/mo: 3-month contract, providing 24 PT sessions total (broken down to 8 sessions per month).

    • From £405.00/mo: 3-month contract, providing 36 PT sessions total (broken down to 12 sessions per month).

    • From £540.00/mo: 3-month contract, providing 48 PT sessions total (broken down to 16 sessions per month).

S1.2 Upgrades, Downgrades, and Cancellations

  • Upgrades: You may upgrade your Membership Plan via email at any time, and your fees will increase accordingly.

  • Downgrades: Plan downgrades are only available after your original contract period has expired. A downgrade requires a 30-day notice period via email.

  • Cancellations: To terminate a rolling membership, you must submit a written request via email. Cancellation cannot take effect until your initial contract has ended.

  • The 30-Day Notice Rule: All cancellations and downgrades are subject to a 30-day notice period from the date of the email. If a scheduled monthly payment falls within this 30-day window, that payment remains fully due. Your access will continue until the end of that paid period, and the subsequent payment will be cancelled/amended.

  • Non-Transferable: Memberships belong strictly to you and cannot be transferred to another person.

S1.3 PT Booking & Rescheduling Rules

  • PT Session Breakdown: PT sessions are allocated strictly per payment month based on your tariff.

  • 24-Hour Notice Rule: PT sessions are booked in advance. If you cancel or reschedule a session with less than 24 hours' notice, that session is permanently lost.

  • Discretionary Re-arrangement: Late-cancelled sessions can only be rearranged at the sole discretion of management and cannot be automatically 'banked' or rolled into future months.

  • Expiry and Carry-Over: Sessions paid for must ideally be used within that payment month. If personal circumstances prevent completion, sessions can be carried over for a maximum of 2 months, after which they expire.

  • Gym Cancellations: If the Gym has to cancel your scheduled PT session, the session will be fully rescheduled at a convenient time.

S1.4 Fitness Classes

  • Advance Bookings: All classes, workshops, and events must be booked in advance. Places are allocated on a first-come, first-served basis.

  • Additional Fees: If a specific class or workshop requires a fee over and above your monthly membership, this must be paid in full at the time of booking.

SCHEDULE 2: 9-WEEK TEAM TRANSFORMATION PROGRAMME

(Applies strictly to participants enrolled in the 9-Week Transformation package)

S2.1 Fixed-Term Nature

  • The Programme is a 9-week fixed-term fitness and lifestyle package. It has defined start and end dates.

  • It cannot be paused, extended, or transferred to another person or future programme date unless expressly agreed in writing by Gym management.

  • Deliverables: Enrolment includes up to 3 coached training sessions per week, 24/7 gym access for the exact 9-week duration, group coaching support, and a structured nutrition guide.

S2.2 Fixed Package Payments

  • Programme fees are paid in full upfront or via a strictly agreed instalment plan outlined at the point of sale.

  • Failure to make instalment payments on time will result in immediate suspension of gym access, removal from coached sessions, and termination from the programme without a refund.

S2.3 No-Refund Policy

  • Due to the highly structured, limited-capacity nature of this programme, no refunds are available once the Programme has commenced, except where required by statutory UK law.

  • Illness and Injury: No refunds or partial credit will be issued if a participant becomes ill, suffers an injury, or is unable to complete the programme for personal or unforeseen reasons. At the Gym's absolute discretion, reasonable workout modifications may be offered to accommodate physical limitations, but package extensions are not guaranteed.

S2.4 Attendance and Missed Team Sessions

  • Coached group sessions are scheduled tightly in advance.

  • Missed sessions cannot be refunded, cannot be carried over, and cannot be exchanged for alternative gym services or 1-on-1 PT sessions. Consistent attendance is entirely the participant's responsibility.

S2.5 Nutrition and Results Disclaimer

  • General Lifestyle Guidance: The nutritional structure provided is for general fitness and lifestyle purposes. It does not constitute medical advice and does not replace a registered dietitian. Plans are based entirely on information provided by you in your consultation form; the Gym is not liable for errors resulting from inaccurate self-reporting.

  • Results Disclaimer: The Gym does not guarantee specific weight loss, fat loss, or strength metrics. Outcomes vary entirely based on individual genetics, effort, consistency, and adherence to the programme outside the gym floor.

S2.6 Operational Changes

  • The Gym reserves the right to make reasonable operational changes to session times, coaching staff assignments, or specific programme structures where necessary to ensure safe and complete delivery of the 9-week cycle.
